Residential property: legal regulations for acquisition of land plots by foreigners

The acquisition of property in Switzerland by foreigners is rigorously restricted by The Federal Law for Limiting the Rights of Foreigners to Acquire Land Abroad (Bundesgesetz ueber den Erwerb von Grundstuecken durch Personen im Ausland). This law is usually referred to as the law of Lex Friedrich or the law of Lex Koller.

According to this law, the definition “foreigners abroad” encompasses both EU citizens, EFTA citizens and citizens of other foreign states, whose permanent place of residence happens to be situated beyond the Swiss borders and who do not hold a Swiss residence permit. In short, the law encompasses all non-Swiss residents.

The aim of this law is to limit the acquisition of land in Switzerland by non-residents.
